Hmmm that is a good question, I'm not really sure of the answer but I think it should be legal.

From my research so far it seems like they are coming down harder on casino gambling than on online poker. It also seems like online poker has a much larger base of poker stars backing it up.

Hopefully wth the election of a new president maybe he will do the sensible thing and make online gambling legal and start taxing gaming revenues online. This would be a win-win situation for everyone.

Since the laws address the transfer of money for gambling, I just bet playing poker with real money and online, is still illegal.

I have heard of people finding ways around this though, like using money processors that aren't US based or using grocery store debit cards.

The legal position on online gambling is quite murky but poker is definitely within the definition of gambling not withstanding the fact that it is a game that requires great skills.

I don't think its legal, it is mostly considered with gambling or something badder than that and the laws had become harder nowadays.
